Terms of Service

These terms govern your use of roam.rentals and the Roam booking service, operated by Mike Melchiot from the United States. By creating an account, listing a vehicle, or booking one, you agree to them. Please read section 6 carefully — Roam is a booking platform, not the renter, owner, or insurer of any vehicle.

0. Who operates Roam

Roam is operated by Mike Melchiot, 1406 S. Ringgold Street, Philadelphia, PA 19146, USA. You can reach us at info@roam.rentals.

1. Who can use Roam

You must be at least 18 years old and able to enter a binding contract. To rent a vehicle you must hold a valid driver’s licence for that class of vehicle and carry it while riding. You are responsible for keeping your account credentials secure.

2. What Roam is — and is not

Roam is an online marketplace that connects independent vehicle owners (“Owners”) with people who want to rent them (“Riders”). Roam does not own, operate, rent out, or insure any vehicle. The rental itself is a direct agreement between the Owner and the Rider, on the Owner’s own rental contract. Roam is not a party to that agreement. Our role is to host listings, collect the information needed to verify users, coordinate bookings, and collect our service fee.

3. Owner responsibilities

  • List only vehicles you own or are authorised to rent out, with accurate details, photos, and pricing.
  • Keep the vehicle roadworthy, registered, and legal to operate, and provide it clean and fuelled as described.
  • Provide your own written rental contract, which the Rider signs before the booking is confirmed.
  • Honour confirmed bookings and be reachable for the handover.
  • Handle your security deposit, damage assessment, and any dispute over the vehicle’s condition directly with the Rider, under your rental contract.

4. Rider responsibilities

  • Hold and carry a valid driver’s licence, and ride lawfully — wear a helmet, obey traffic laws, and never ride under the influence of alcohol or drugs.
  • Use the vehicle only as permitted in the Owner’s rental contract, and return it on time in the condition you received it.
  • Take responsibility for damage, loss, theft, traffic violations, and fines that occur while the vehicle is in your care, as set out in the Owner’s contract.
  • Pay the Owner directly for the rental and any deposit at handover, as agreed.

5. Payments, fees, and deposits

Owners keep the large majority of the rental price; Roam charges a service fee on each booking (currently 15%, or 10% for founding Owners). To confirm a booking, the Rider pays a reservation payment online through our payment processor — Roam’s service fee, any Roam-provided add-on, and card / e-wallet processing — which appears on the Rider’s statement as Roam Rentals. The Owner’s share of the rental, any fuel add-on, and any security deposit are paid directly to the Owner at handover, in cash or GCash; Roam does not hold or handle the Owner’s funds or the deposit. Reservation payments are refunded only as set out in section 7 and our Cancellation & Refund Policy; otherwise service fees are non-refundable except where required by law. Security deposits are set, held, and returned by the Owner, not Roam.

6. No insurance — assumption of risk

Roam does not provide, arrange, or include any insurance. Any “roadside” add-on is a dispatch and assistance service only, not insurance. Riding a motorbike or scooter carries real risk of injury, death, and property damage. To the extent permitted by law, you assume that risk, and any coverage is a matter between you and the Owner under the rental contract, or your own separate insurance.

When you add roadside to a booking, it covers help dispatched to you anywhere on Siquijor if the vehicle fails — a fix on the spot where possible, or a replacement vehicle (a bike swap) where it is not. A breakdown that is not your fault is the Owner’s responsibility: the Owner either provides a replacement for the rest of your trip, or refunds the unused portion. If the Owner refunds and cannot replace the vehicle, Roam helps you re-book another vehicle and waives its own platform fee up to what you already paid, so a mechanical failure does not cost you your trip. Damage or a breakdown caused by the rider — an accident, misuse, or ignoring a known fault — is the rider’s responsibility under the Owner’s rental contract, and any repair or replacement cost falls to the rider. Roadside remains a dispatch and assistance service, not insurance.

7. Cancellations, no-shows, and refunds

  • Cancel 48 hours or more before the pickup day: your reservation payment is refunded in full and the dates are released.
  • Cancel less than 48 hours before the pickup day, or fail to show up: the reservation payment is forfeited. That forfeit is the entire penalty — no further or separate charge is ever taken.
  • A no-show also leaves the other party stranded, so they are compensated ₱750 per two days of the booking, and the no-showing account may be suspended or banned.
  • If the Owner cancels or does not show, your reservation payment is refunded in full and we help you find a replacement vehicle.

8. Identity verification

We collect government IDs from Owners and driver’s licences from Riders and may verify them, but we do not and cannot guarantee the identity, licensing, conduct, or reliability of any user, or the condition or legality of any vehicle. Use good judgement, and inspect a vehicle before you ride.

9. Disclaimers and limitation of liability

The Roam platform is provided “as is” and “as available”, without warranties of any kind. To the fullest extent permitted by law, Roam is not liable for accidents, injury, death, property damage, theft, disputes, or losses arising from a rental or from dealings between Owners and Riders — those are between the parties to the rental contract. To the fullest extent permitted by law, Roam’s total liability to you for any claim relating to the service is limited to the total service fees you paid to Roam in the three months before the claim.

10. Indemnity

You agree to indemnify and hold Roam harmless from claims, damages, and costs (including reasonable legal fees) arising out of your use of the service, your rental, your breach of these terms, or your violation of any law or the rights of another person.

11. Prohibited conduct

  • Providing false information, or impersonating another person.
  • Listing a vehicle you may not lawfully rent out, or riding without a valid licence.
  • Using the service for anything unlawful, or to harass, defraud, or endanger others.
  • Attempting to bypass Roam’s fees, interfere with the platform, or misuse another user’s data.

12. Suspension and termination

We may suspend or close an account that breaches these terms, poses a safety or fraud risk, or as required by law. You may close your account at any time from your account settings.

13. Governing law and disputes

These terms are governed by the laws of the Commonwealth of Pennsylvania and the United States, without regard to conflict-of-laws rules. Nothing here removes mandatory consumer or data-protection rights you have under the laws of the Philippines where they apply to you. We will always try to resolve a dispute with you directly first — please email us before taking any other step.

14. Changes to these terms

We may update these terms as the service grows. When we do, we will change the date at the top, and continued use of Roam after a change means you accept the updated terms.
